California Consumer Privacy Notice

This PRIVACY NOTICE FOR CALIFORNIA RESIDENTS supplements the information contained in the Privacy Statement of iDirect Government, LLC, its affiliates, and its subsidiaries (collectively, “we,” “us,” or “our”) and applies solely to the personal information of visitors, users, and others who reside in the State of California (“consumers” or “you”). This notice also does not apply to personal information we collect about job applicants, independent contractors, or current or former full-time, part-time and temporary employees or staff, officers or directors. We adopt this notice to comply with the California Consumer Privacy Act of 2018 and regulations adopted pursuant to the Act, each as may be amended from time to time (“CCPA”) and other California privacy laws. Any terms defined in the CCPA have the same meaning when used in this notice. This notice does not address or apply to our collection or processing of information that is not subject to the CCPA.

Information We Collect

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“personal information”).

In particular, we may collect and may have collected the following categories of personal information from consumers within the last twelve (12) months. We may disclose each category of personal information we collect to a service provider or contractor for a business purpose.

A real name, email address, or other similar identifiers.

B. Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e))

A name, signature, address, telephone number, current employer or job title. Some personal information included in this category may overlap with other categories.

C. Characteristics of protected classifications under California or federal law

Age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, veteran or military status, genetic information (including familial genetic information).

D. Commercial information.

Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

E. Biometric information

Genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as, fingerprints, faceprints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data.

F. Internet or other similar network activity information

Browsing history, search history, information on a consumer's interaction with a website, application, or advertisement.

G. Geolocation data.

Physical location or movements.

H. Audio, electronic, visual, thermal, olfactory, or similar information

Audio, electronic, visual, thermal, olfactory, or similar information.

I. Professional or employment-related information.

Current job title.

J. Education information

Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, student disciplinary records, and other information about your educational history or background that is not publicly available personally identifiable information as defined under the Family Educational Rights and Privacy Act.

K. Inferences

Such as inferences drawn from any of the information identified above to create a profile reflecting a person's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

Disclosures to Recipients

We may disclose the above categories of personal information to the following categories of recipients: service providers; contractors; advisors and agents, regulators, government entities, and law enforcement, affiliates and subsidiaries, and benefits providers. 

Sources of personal information

We obtain the categories of personal information listed above from the following categories of sources: Directly and indirectly from activity on our website (www.idirectgov.com). For example, from submissions through our website portal or website usage details collected automatically. 

Purposes and Use of Personal Information

We may use or disclose the personal information we collect for one or more of the following business purposes:

  • To carry out or fulfill or the purposes for which the personal information was collected.
  • To respond to inquiries or complaints and to provide you with information, products, or services that you request from us or for other customer service purposes.
  • To provide you with email alerts, event registrations, and other notices concerning our products or services, or events or news that may be of interest to you.
  • For general business operations and other business administrative purposes.
  • To improve our website and present its contents to you.
  • For testing, research, analysis, and product development.
  • As necessary or appropriate to investigate, prevent, or take action regarding illegal activities, suspected fraud, and situations involving potential threats to the safety of any person, and to otherwise protect our rights, property, and safety, or that of our clients or others.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • As described to you when we collect your personal information or as otherwise set forth in the CCPA.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Retention

We retain the personal information we collect only as reasonably necessary for the purposes described above or as otherwise disclosed to you at the time of collection. For example, we will retain information as necessary to comply with our tax, accounting, and recordkeeping obligations, to provide you with the services you have requested, as well as an additional period of time as necessary to protect, defend, or establish our rights, defend against potential claims, and comply with our legal obligations. In some cases, rather than delete your personal information, we may deidentify or aggregate it and use it in compliance with the CCPA.

Sensitive Personal Information

We do not use or disclose sensitive personal information beyond the purposes authorized by the CCPA. Accordingly, we use and disclose sensitive personal information as reasonably necessary (i) to perform our services requested by you, (ii) to help ensure security and integrity, including to prevent, detect, and investigate security incidents, (iii) to detect, prevent and respond to malicious, fraudulent, deceptive, or illegal conduct, (iv) to verify or maintain the quality and safety of our services, (v) for compliance with our legal obligations, (vi) to our service providers who perform services on our behalf.

 

California Residents Rights and Choices

The CCPA provides California residents with specific rights regarding their personal information. This section describes California residents’ CCPA rights and explains how to exercise those rights.

Right to Opt-out of Sale or Sharing of Personal Information

California privacy laws define a “sale” as disclosing or making available to a third-party personal information in exchange for monetary or other valuable consideration, and “sharing” broadly includes disclosing or making available personal information to a third party for purposes of cross-context behavioral advertising. We do not sell or share (as defined by the CCPA) personal information, sensitive personal information, or the personal information of individuals we know who are under sixteen (16) years of age.

Right to Know

California residents have the right to request that we disclose certain information, up to twice in a 12 month period, regarding the personal information (including sensitive personal information, if applicable) we have collected about them. Upon receipt of a verifiable request, we will disclose, as applicable:

  • The categories of personal information we have collected about the California resident;
  • The categories of sources from which personal information is collected;
  • The categories of personal information about the California resident that we have disclosed for a business purpose;
  • The categories of personal information about the California resident that we have sold or shared (if any);
  • The categories of third parties to whom we have disclosed, sold, or shared personal information;
  • The business or commercial purposes for collecting, selling, or sharing personal information; and
  • The specific pieces of personal information we have collected about the California resident.

Right to Delete

California residents have the right to request that we delete their personal information, subject to certain exceptions.  

Right to Correct

California residents have the right to request correction of inaccurate personal information we maintain about them, subject to certain exceptions.

Right to Non-Retaliation

California residents have the right not to be subject to retaliatory treatment for exercising their rights under the CCPA.

Exercising Rights

To exercise the rights described above, please submit a request to us by either:

Authorized agents may initiate a request on behalf of another individual through one of the above methods; authorized agents will be required to provide proof of their authorization and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent.

When you submit a request, we will take steps to verify your identity and request by matching the information provided by you with the information we have in our records. In some cases, we may request additional information in order to verify your identity, or where necessary to process your request. If we are unable to verify your identity after a good faith attempt, we may deny the request and, if so, will explain the basis for denial.

Changes to Our Privacy Notice

We reserve the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will notify you by email or by posting on our website or through a notice on our website homepage.
